By accessing or using Lumelena ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Lumelena.

2. Description of Service

Lumelena provides AI-powered photo generation services. Users upload selfies, select an aesthetic style, and receive professionally generated photos. The Service processes photos using artificial intelligence to apply selected visual styles while maintaining natural facial features.

3. Eligibility

You must be at least 16 years old to use Lumelena. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have obtained parental or guardian consent.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not share your account credentials or allow multiple users to access the Service through a single account.

5. Acceptable Use

You agree NOT to use Lumelena to:

• Upload photos depicting individuals without their consent
• Generate, distribute, or use content that is illegal, harmful, or offensive
• Create deepfakes, celebrity images, or any content that could defame or impersonate others
• Attempt to reverse engineer, copy, or extract the AI models and technology
• Resell, redistribute, or commercially exploit the generated photos beyond personal use
• Use automated systems or bots to access the Service without authorization
• Upload content that infringes on intellectual property rights

6. Content Ownership & License

Your Content: Your Content: You retain all rights to the photos you upload ("User Content"). You grant Lumelena a limited, non-exclusive license to process your User Content solely for the purpose of providing the Service.

Generated Content — Free Photos: Generated Content — Free Photos: Photos generated using free credits are licensed for personal use only. Commercial use, including using them for business promotions, advertising, or resale, is not permitted.

Generated Content — Paid Photos: Generated Content — Paid Photos: Photos generated using paid credits or subscriptions include full commercial rights. You own the generated photos and may use them for personal, commercial, and social media purposes without attribution. Lumelena retains no rights to your generated photos.

By using our Service, you represent that you own or have the necessary rights to the photos you upload, and that the generation and use of AI photos based on your uploads does not violate any third-party rights.

7. Payment & Billing

Paid features are billed through Stripe. All prices are listed in USD unless otherwise specified. Subscription plans are billed monthly or annually, depending on your selected plan. You authorize Stripe to charge your payment method for all applicable fees.

8. Intellectual Property

Lumelena's name, logo, website, AI models, technology, and all related intellectual property are owned by Lumelena. These Terms do not grant you any license to use Lumelena's intellectual property beyond your use of the Service.

You may not use "Lumelena" or our logo in a manner that could imply endorsement of your products or services without our prior written consent.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We are not liable for any service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Lumelena shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Lumelena, its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of the Service.

12. Governing Law

These Terms are governed by the laws of the United States. For EU users, this shall not affect your rights under mandatory consumer protection laws of your country of residence. Any disputes shall be resolved in the courts of the United States.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the modified Terms.
